TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) govern the provision of property reporting services by The Inventory Studio (“the Contractor”) to estate agents, landlords, or clients (“the Client”). By engaging the Contractor, the Client agrees to the terms set out below.
1. Services Provided
1.1 The Inventory Studio provides independent property reports, including but not limited to:
Check-in reports
Check-out reports
Mid-term inspections
1.2 Services are limited to the preparation and delivery of reports. The Contractor does not manage deposits, tenancy agreements, or maintenance arrangements, and will not act as a letting agent or property manager.
1.3 All reports will be provided in a professional format, including written descriptions, photographs, and any agreed additional data.
2. Booking and Acceptance
2.1 Services are scheduled upon mutual agreement of date, time, and fee.
2.2 The Client must provide full access to the property at the agreed time, including keys or codes if required.
2.3 The Contractor reserves the right to refuse or reschedule appointments if safe access cannot be provided.
3. Fees and Payment
3.1 Fees for services are outlined in the published Service & Rates sheet, or as agreed in writing prior to work commencing.
3.2 Invoices are payable within 5 days of issue unless otherwise agreed.
3.3 Late payments may incur interest at 5%.
3.4 Appointments requested or conducted on Saturdays or UK public holidays will incur an additional 20% surcharge on the standard service rate.
4. Cancellations and Rescheduling
4.1 No cancellation charges up to 24 hours’ notice by telephone or email.
4.2 Cancellation within 24 hours will incur a charge of 25% of invoice (late cancellation).
4.3 If we are unable to have access to property at agreed appointment date and time, contractors still on-site causing delays in inspections or tenant / landlord not present at agreed time, either will be charged as stated 25%. Cancellations on the day where sufficient notice is provided or we have not already reached the property and the appointment is re scheduled within 14 days will not be charged. A full refund will be given for cancellations which are 24hrs in advance of booking and not re scheduled.
4.4 The Contractor reserves the right to cancel or reschedule due to illness, emergency, or unsafe conditions, with notice to the Client.
5. Limitation of Liability
5.1 Reports are prepared to professional standards, but the Contractor cannot be held liable for disputes, losses, or damages arising from the tenancy, property, or its management.
5.2 The Contractor’s liability, whether in contract, tort, or otherwise, is limited to the fee paid for the specific report in question.
5.3 The Client acknowledges that reports are advisory and for record purposes only.
6. Intellectual Property
6.1 All reports, photographs, and materials produced by The Inventory Studio remain the copyright of the Contractor.
6.2 Clients may use reports for the management, marketing, and legal purposes of the property but may not reproduce or sell them without written permission.
6.3 Photos of any reports will be of structural/maintenance items, never personal possessions unless unavoidable or written consent has been provided by the Client.
7. Data Protection
7.1 The Inventory Studio complies with all relevant data protection laws (including GDPR).
7.2 Personal data provided by the Client will only be used for the purpose of delivering the contracted services and will be stored securely.
8. Governing Law
This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising will be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Acceptance of Terms
By engaging The Inventory Studio, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions.
DISCLAIMER
The Inventory Studio takes every reasonable step to ensure that the information available on this Website is correct. However, The Inventory Studio does not guarantee this Website content is fully correct or complete at any time. this Website may make changes to this Website content at any time and without notice. This Website content may be out of date, or occasionally incorrect and this Website is not obliged to ensure that such material is correct or up-to-date.
This Website content is provided “as is” without any conditions or warranties of any kind. To the maximum extent permitted by the law, The Inventory Studio excludes all and any representations, warranties and conditions that may have effect in relation to this Website.
EXCLUSION OF LIABILITY
Neither The Inventory Studio nor any other party whether or not involved in producing, maintaining or delivering this Website, shall be liable or responsible for any kind of loss or damage to you or a third party arising out of your or their use of this Website. This exclusion shall include maintenance or repair costs of this Website and, without limitation, any other direct, indirect or consequential loss, whether in tort or contract law or otherwise. 
Nothing in these Terms and Conditions shall exclude or limit liability for:
a) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977);
b) fraud;
c) misrepresentation as to a fundamental matter;
d) any liability which cannot be excluded or limited under the law of the United Kingdom.

DATA RETENTION POLICY

Purpose
This policy explains how The Inventory Studio (“we”, “our”, “us”) requests, stores and deletes the personal data we collect while providing property inventory, check-in, check-out, and inspection services.
Scope
This policy covers all personal data we process in the course of providing services to:
Letting and estate agents
Landlords
Tenants whose details may appear in reports
Contractors and suppliers
Data We Retain
Property Reports (inventory, check-in, check-out, mid-term inspections) including photos, video, and related notes.
Client Records (names, business addresses, email, phone numbers).
Booking and Invoicing Details (appointment dates, property addresses, invoices, payments).
We do not store bank card details.
Retention Periods
To meet contractual obligations and protect all parties in the event of a dispute, we retain data for the following periods:
Data Category Retention Period
Property reports & supporting media 6 years from the end of the tenancy or the date of the final service, unless a dispute is ongoing.
Client contact details & invoices - 6 years from the end of the financial year in which the record was created (to meet HMRC requirements).
Email correspondence related to a service - 6 years, or until any related dispute is resolved, whichever is later.
If a dispute, legal claim, or audit is ongoing, we will keep the relevant data until it is fully resolved.
Secure Storage & Deletion
All reports and documents are stored on encrypted, password-protected systems.
Physical notes (if any) are kept in locked storage.
When the retention period expires, data is securely deleted or shredded so it cannot be reconstructed.
Legal Basis
Retention is based on:
Contractual necessity (fulfilling our service agreement with you).
Legitimate interests (defending or establishing legal claims, including tenancy-deposit disputes).
Legal obligations (accounting and tax requirements under UK law).
Client Rights
Clients may request access to, or deletion of, their data earlier if:
It is no longer required for the purposes above, and
No legal claim or statutory requirement prevents deletion.
